Whitewater Brewing Co. – Subscription Policy

Whitewater Brewing Company (“Whitewater,” “we,” “us,” or “our”) offers subscription services through our Shopify online store to provide recurring deliveries of select beer and beverage products. By purchasing a subscription, you agree to the terms outlined below.


1. Eligibility & Legal Requirements

By purchasing a subscription, you confirm that:

  • You are of legal drinking age in Ontario (19 years or older) at the time of purchase and at the time of delivery

  • The subscription delivery address is located in Ontario, Canada

  • You will be present (or ensure a legal-age recipient is present) to accept delivery, where required

Whitewater Brewing Company reserves the right to verify age at checkout and/or delivery and to cancel subscriptions that do not meet legal requirements.


2. Subscription Products & Billing

a) Subscription Structure

Subscription offerings may include beer, mixed packs, seasonal selections, or curated releases. Product availability may vary by cycle based on production schedules and inventory.

b) Billing Frequency

Subscriptions are billed on a recurring basis (e.g., monthly, quarterly, or other cadence as specified at purchase). Your payment method will be automatically charged at the start of each billing cycle.

c) Pricing & Taxes

  • Subscription pricing is displayed at checkout

  • Applicable HST and shipping fees are calculated at checkout

  • Prices are subject to change with advance notice (see Section 7)


3. Shipping & Delivery

  • Subscriptions ship within Ontario only

  • Shipping timelines may vary based on location, weather, holidays, and carrier availability

  • Failed deliveries due to absence, incorrect address, or age-verification refusal may result in additional fees or forfeiture of the shipment

Whitewater Brewing Company is not responsible for delays caused by carriers, weather conditions, or circumstances beyond our control.


4. Managing Your Subscription

You may manage your subscription at any time through your Shopify customer account, including:

  • Skipping a shipment 

  • Updating your delivery address (Ontario addresses only)

  • Updating payment information

  • Cancelling your subscription

Changes must be made before the order cut-off date indicated in your account to apply to the upcoming billing cycle.


5. Cancellations

  • Subscriptions may be cancelled at any time prior to the next billing date

  • Once an order has been processed or shipped, it cannot be cancelled or refunded

Cancelling a subscription does not affect any previously fulfilled or in-progress orders.


6. Returns, Refunds & Exchanges

Due to the nature of alcohol sales:

  • All subscription sales are final

  • We do not accept returns or exchanges on beer or beverage products

If your order arrives damaged, incorrect, or incomplete, please contact us at cheers@whitewaterbeer.ca within 48 hours of delivery with photos and order details. We will assess the issue and, where appropriate, provide a replacement or store credit at our discretion.


7. Changes to Subscription Offerings or Pricing

Whitewater Brewing Company reserves the right to:

  • Modify subscription contents due to seasonal availability or production constraints

  • Adjust pricing with reasonable advance notice via email or account notification

Continued participation in the subscription after notice constitutes acceptance of the updated terms.


8. Pausing or Termination by Whitewater Brewing Company

We reserve the right to pause or terminate subscriptions at our discretion, including but not limited to cases involving:

  • Regulatory or licensing changes

  • Suspected fraud or misuse

  • Non-compliance with legal age or delivery requirements

Any prepaid but unfulfilled shipments affected by termination will be handled in accordance with applicable law.


9. Limitation of Liability

To the fullest extent permitted by law, Whitewater Brewing Company shall not be liable for indirect, incidental, or consequential damages arising from subscription use, delivery delays, or product availability, except where prohibited by law.


10. Governing Law

This Subscription Policy is governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
